Provencio’s defense calls 1 witness; jury expected to hear closing statements early Tuesday

first_imgby Tracy McCue, Sumner Newscow — It took the State of Kansas five days of testimony to wrap up its case against Sylvester Provencio, charged with aggravated battery, a level 5 felony.It took the defense less than five minutes.After Sumner County Attorney Kerwin Spencer closed his case Monday afternoon, Provencio’s defense attorney Jess Hoeme called on Sumner County Detective Keith Bristor to the stand. He asked if there was any blood samples taken at the scene of the alleged crime.Bristor said there was not.Bristor said he took over for Jeff Hawkins as the Sumner County Sheriff Detective in 2015. The April 22, 2015 brawl in southern Sumner County was one of the last cases that Hawkins investigated. Bristor said he knew of no blood evidence that was submitted or documented to a state forensic crime lab.Provencio then declined to testify in his behalf. Hoeme then rested his case.Sumner County District Judge Scott McQuin then excused the jury for the day, and told them to reconvene on 9 a.m. Tuesday where both County Attorney Kerwin Spencer and Hoeme will present their closing arguments. The 12-person jury is then expected to start deliberation thereafter.Shortly after the state rested this afternoon, Hoeme asked the judge to dismiss the aggravated battery charge because there was not enough sufficient evidence that Provencio used force against Greg Schneider, 53, of Caldwell, who sustained significant injuries during the melee.Hoeme said the melee involving four Caldwell men, five miles east of Caldwell, which started over a truck being stuck. There was essentially two fights going at the same time, Hoeme said – one between Provencio and Brian Nispel while Reedy and Schneider were fighting elsewhere. He said since there is no evidence that Provencio hurt Schneider, then there is no reason that he should be charged with aggravated battery.McQuin said, he too has doubts that there is enough evidence to convict Provencio of aggravated battery. But he told Hoeme he was not prepared to rule on the matter and would like to see what the jury thinks.McQuin also said the only solid evidence linking Provencio to Schneider was Wednesday’s testimony of Nispel.Nispel said on the stand that he was fighting with Provencio in the opposite ditch, when he was able to escape, get in his truck and make a U-turn. It was only then that he said he saw Provencio along with Reedy kicking an unconscious Schneider.Hoeme said that there is no shred of evidence that links Provencio to any of the injuries that Schneider incurred.Both men testified last week the brawl was initiated by a verbal confrontation between Provencio and Schneider, before Nispel arrived. However, when Nispel did arrive, Provencio diverted his attention to Nispel. The melee ensued when Provencio and Nispel started fighting in the opposite ditch while Reedy and Schneider were scrapping in front of Schneider’s pink Cadillac.Nispel said once he got away from Provencio, according to his testimony, he told Schneider “let’s get out of here” before getting into his pickup and driving in a southward direction. That was when he called Sumner County 911.Between that brief exchange with Schneider to when Nispel made a U-turn several feet south, Schneider had been knocked to the ground with what appeared to be a blow to the head.Nispel said he didn’t see the blow, but when he started driving forward, the two younger men were kicking at an unconscious Schneider on the ground. He then used his pickup to attempt knock Provencio and Reedy into the ditch.Sumner County Attorney Kerwin Spencer had introduced a metal pipe piece into evidence that was found in Schneider’s pink Cadillac after it was recovered in Caldwell. Provencio and Reedy took Schneider’s car and drove it back into town. However, the judge ruled the metal piece was irrelevant in that there was not enough substantial DNA evidence that the metal piece had anything to do with the brawl.Reedy has pled guilty to aggravated battery last week and is awaiting sentencing in July.Hoeme said it was likely that Reedy made the blow to Schneider and that the only contact Provencio made with Schneider was a swing that never made contact during the initial conversation.“The aggravated battery charge is mitigated by emotion,” Hoeme said. “But there is no solid evidence that is supported by law and facts. Bomi Health Admin, Family Test Positive for Ebola

first_imgCredible reports reaching the Daily Observer from Tubmanburg, Bomi County, have revealed that the government-run hospital in Bomi County has been shut down.According to our sources, this is largely because Mr. Sando Sirleaf, the County Health Services Administrator (CHSA), and his family of 10 have been tested positive with the deadly Ebola virus, which is ravishing the nation.One of our sources, who is very close to the hospital, the county’s only referral hospital and major health facility, however, clarified that the hospital’s doors have not been totally closed, but that all of the patients, including admitted ones, have fled.Our source also said the Out-Patient Department (OPD) for routine treatments for malaria and other “common sicknesses,” is also empty, as out-patients have stopped coming to the hospital.According to our source, who has asked to remain anonymous, “Even most of the nurses have now left the hospital because they are afraid for their lives. This is why I said the hospital has now closed.”Our source further disclosed that on Sunday, July 27, the only two out-patients that went to the hospital were the last two remaining family members of the county’s Health Service Administrator, Mr. Sirleaf.The Daily Observer learned  that Mr. Sirleaf and nine members of his family were brought to Monrovia for screening after his son, Sando Sirleaf, Jr., head of the Gayah Hill Health Center, had tested positive with the Ebola virus, which is taking the lives of people every day.Following the screening, our Health Correspondent was reliably told that eight tested positive, are now isolated and are being given supported treatment by health workers. It was the last two, who were confirmed Sunday, as also having come down with the virus.Another source, who is also a Sirleaf, but no relation to Sando, said he is a very good friend of the Bomi Health Service Administrator’s entire family. That’s on top of the shared contacts API released in December of 2008. More Facebook Than GmailBy letting users search and interact with user profiles regardless of whether they are “contacts” or not, Google Apps has become slightly more like a corporate social network. While it still deigns to use terminology like “address book” instead of a friend and/or subscriber list, it’s no longer tied to behaving like email. Not to say that this is revolutionary for Apps. On the contrary, enterprise users of the suite would naturally demand full access to profiles, since there’s no logical reason why you shouldn’t have at least theoretical access to the contact information of everyone in your company using the platform. 3 Areas of Your Business that Need Tech Now With some core changes to contacts, Google Apps has dipped a toe in to the enterprise social networking waters. As of today, Apps contacts exhibits shades of Facebook and Twitter by allowing you to find and interact with all the user profiles in your Apps suite. According to Google, these adjustments where made at the behest of enterprise Apps users. It has also made a user profiles API available to Premier Edition customers, one that allows IT to retrieve and manipulate data about all the people using Apps in a company. How the New Contacts WorkPreviously, contacts within Google Apps functioned just like email: only people you’d previously communicated with or added intentionally appeared. But now, a search will provide profiles from your company’s entire address book, acting very similar to the way enterprise social networking platforms treat user profiles. Move the iPhone around in your hand, while keeping your eyes on the home screen, and you’ll see what looks like two different layers—one with the flat icons floating above a deeper-set wallpaper. DeepEnd did it first, and a new tweak called 3DBoard does something similar. But iOS 7 has effectively done away with the need for both now.Clockify (replaced by Clock app)iOS 7’s home screen clock icon now keeps real time. Plus, it also includes full notifications and Control Center access, so if you’re yearning for a change, the new stock screen should fit the bill. Auto App Updater (replaced by App Store)Manually installing updates for apps may feel like a chore. Auto App Updater, however, made easy work of this, automatically handling the process when need be. No more need for that now, since iOS 7 gives the App Store autoupdate features. This is the reason Winterboard is often the first thing people grab when they first access Cydia. Others want to boost performance, so they download Nitrous. This hack accesses the native Nitro JavaScript engine, which is intended only for Apple apps like Safari and iBooks, to significantly speed up apps that use the WebKit layout engine. And there are still other features only available through jailbreaking, like being able to: Use widgets (Dashboard X)Rename apps (Rename)Change the default browser (BrowserChanger) or maps app (MapsOpener)Tether laptops without a subscription (MyWi, TetherMe)Try out Google Now–like features (NowNow)Create multiple user accounts (iUsers)Quick reply text-messaging (BiteSMS)Block ads (AdBlocker) Newer iOS users may not realize it, but video recording, multitasking, copy/paste and customizable notifications, among others, were initially only available to people who jailbroke their iOS devices to add unsanctioned features. Then little by little, Apple integrated those functions into its mobile platform. Now, with iOS 7, the company has done it again. This software version contains no ordinary features. In some cases, they’re among the most popular among jailbreakers today. That means when Apple launches the new software—on or around September 10—there will be fewer reasons to hack into that iDevice. Let’s take a look at which jailbreak tweaks can head to the scrap heap now, and what remains in the balance. Cydia Apps Killed By iOS 7See also Yup, Jailbreaking Your iPad Really Is IllegalJailbreaking refers to hacking that breaks Apple’s restrictions over an iPhone, iPad or iPod touch. It allows users to access new or hidden settings with unofficial apps, most of which come from Cydia, the primary repository of unsanctioned programs. But Apple is not amused. It has infamously tried to make jailbreaking illegal (to no avail, at least for iPhones. iPads are another story). And at every turn, it aggressively patches the security vulnerabilities that make the hacks possible. All this posturing, however, may not be necessary. The company already has its best bet to end jailbreaking, and it’s a rather simple solution: Just give users the features they want, so they don’t have to hack to get them. Indeed, as iOS evolves, it increasingly co-opts features that were once jailbreak-only. In a few weeks, when iOS 7 launches, it will continue that tradition. Here are some of the Cydia tweaks that Apple’s new software update has appropriated: Auxo (replaced by Control Center and multitasking)There’s no secret to the immense popularity of the Auxo iOS task switcher, which offers live previews of active apps, swipe-to-delete one or multiple apps, system toggles for quick access to Wi-Fi, Bluetooth and screen brightness.
